TERMS OF USE OF THE SITE
We welcome you to www.maddalena.it (“Site”), managed by Maddalena S.p.A., with registered office in via G.B. Maddalena, 2/4 – 33040 Povoletto (UD) T.C. 80008170302, VAT NO. IT00617140306 and REA UD – 128629. These Terms set out the terms of use under which you may access and use this Site. Therefore, browsing the Site implies knowledge and acceptance of these Terms and, in the case of access to restricted areas, of the relevant Terms.
All the contents of the Site (by way of example: images, texts, music and sounds, drawings and graphic representations, layout) are owned by Maddalena S.p.A. and protected by the intellectual property rights of Maddalena S.p.A; therefore, their reproduction, even in part or even temporarily, in any form or by any means is prohibited.
All distinctive signs of the products displayed or described on the Site are registered and are the exclusive property of Maddalena S.p.A.
The images and descriptions on the Site are merely representative and are not binding, also considering changes that may affect the products. The representations and descriptions of the products will be exclusively those indicated at the time of purchase.
These Terms of Use are governed by Italian law.
TERMS AND CONDITIONS
for the use of the My Maddalena platform
Maddalena S.p.A. provides, through access to the confidential area of the My Maddalena platform, a series of services and support tools for the installation, use and maintenance of its products. The request for credentials and, in any case, access to the confidential area implies acceptance of these provisions.
LOGIN CREDENTIALS
1.1 Login credentials are requested via the function on the My Maddalena page of the www.maddalena.it website.
1.2 Maddalena S.p.A. reserves the right to grant or refuse login credentials, and to enable, depending on the type of user, only part
of the services on the platform.
1.3 Once provided, login credentials are personal and cannot be shared or disclosed to third parties; if the user is a company, credentials will have to be requested for each of the employees who will access the platform, while personal credentials will still be required for the employee concerned. In any event, the use of the platform implies acceptance of these terms and conditions not only by the company, but also by the natural person to whom the credentials are assigned and who physically performs the access.
1.4 Credentials will be disabled if the user does not log in for 24 months.
1.5 Credentials may be disabled by the user via the function on the platform itself.
NATURE OF THE SERVICES OFFERED
2.1 The resources present on the platform are made available by Maddalena S.p.A. with a view to supporting its customers, and do not entail the assumption of any obligation on the part of Maddalena S.p.A., since the respective obligations of the parties remain those provided for in the contract of sale of products with the customer. The services and support provided, including via Customer Service, do not replace the technical documentation delivered with the products, to which the customer must in any case refer, nor do they entail any obligations for services or performances not included in the terms of sale.
2.2 No obligations shall arise for Maddalena S.p.A. even if the services are used by parties other than the customers of Maddalena S.p.A.’s products (e.g. installers, builders, suppliers of water or energy services), assuming that these third parties use the services (including software, also downloaded from the app store, and technical manuals and other product activation tools) on behalf of and for the benefit of Maddalena S.p.A.’s customers as part of the relationship between Maddalena S.p.A. and the latter.
2.3 The indications on the use of the products and on their limits and capacities provided in the context of the delivery of the relevant hardware shall also remain valid and binding, and the information received and/or readings made through the services of My Maddalena shall in any event be interpreted in the light thereof.
2.4 Maddalena S.p.A. may make changes to the services provided (including software, manuals and other tools) at any time, and the user of the platform undertakes to check for updates, always using the latest version of what is made available through My Maddalena.
INTELLECTUAL PROPERTY
3.1 The material that can be viewed is made available by Maddalena S.p.A. strictly within the limits of what is required to carry out the activities on the products for which the services are activated.
3.2 Therefore, the user is not allowed to extract, keep copies of or otherwise use such material for a time or purpose other than the activities on the specific product samples for which the service is provided.
3.3 The dissemination or communication of the material to third parties is in any case prohibited.
