As provided for in Law No. 179 of 30 November 2017, “Provisions for the protection of the authors of reports of crimes or irregularities of which they have become aware in the course of a public or private employment”, in force since 29 December 2017 (so-called WHISTLEBLOWING) and recently renewed by Legislative Decree 24 2023 and Legislative Decree 90/2017 (so-called Anti-Money-Laundering Decree), Maddalena Spa has adopted a suitable computer system to handle this kind of reports.
The new law integrates even more systematically with GDPR 2016/679 for the purpose of greater PROTECTION of the whistleblower/reported person as a “data subject” in the processing of personal data and goes even further in specifying measures to avoid retaliation against the whistleblower.
In order to grant all staff members or others immediate and accessible possibility, provided for by law, to send reports to the 231/2001 Supervisory Board, the Antitrust Supervisory Board and the SPT (Social Performance Team) for SA8000, this page was created, divided into three specific sections, for the specific purpose of Whistleblowing reports concerning illegal behaviour.
REPORTS TO THE SUPERVISORY BOARD ACCORDING TO 231/01 ORGANISATION AND MANAGEMENT MODEL
The rule provides that Maddalena employees and collaborators may anonymously report a situation deemed abnormal, in which it is possible that an illegal act has been committed or, in any case, a violation of the principles and contents of the 231/2001 Management Model. Communications forwarded by this means are sent to the Head of the Supervisory Board (under decree 231/2001), Mr. Giovanni Scalera. Maddalena S.p.A. and its Supervisory Board guarantee strict confidentiality of the facts contained in the reports and the right to maintain anonymity.
Reporting forms are currently available only in Italian
The rule provides that Maddalena employees and collaborators may anonymously report any wrongdoing relating to corporate Antitrust Compliance. Communications forwarded by this means are sent to the Head of the Antitrust Supervisory Board, Mr. Filippo Capomacchia. Maddalena S.p.A. and its Supervisory Board guarantee strict confidentiality of the facts contained in the reports and the right to maintain anonymity.
Reporting forms are currently available only in Italian
The rule provides that Maddalena employees and collaborators may anonymously send any suggestions, reports or complaints concerning the SA8000 Management System. Communications forwarded by this means are received by the representatives of the workers of the Social Performance Team. Maddalena S.p.A. guarantees strict confidentiality of the facts contained in the reports and the right to maintain anonymity. In the case of intentionally non-anonymous suggestion, report and/or complaint, it guarantees not to implement any form of discrimination against the sender.
